1. About these terms
These terms apply when you access the HexaTech website or use a HexaTech customer engagement service. A proposal, order form, subscription plan or other written agreement may add to or vary these terms for a specific service. If there is a conflict, the signed written agreement takes priority.
2. Business use and authority
Our services are intended primarily for organisations and people acting in a business capacity. By creating an account or accepting an order, you confirm that you have authority to act for the relevant organisation and that the information you provide is accurate.
3. Accounts and security
You are responsible for authorised users, secure credentials, appropriate permissions and activity through your account. Tell us promptly if you suspect unauthorised access or a security incident affecting the service.
4. Acceptable use
You must not use the website or services to break the law, infringe another person's rights, distribute malware, gain unauthorised access, interfere with service operation, send unlawful communications, or process data without an appropriate lawful basis. You must not attempt to reverse engineer or resell a service except where a written agreement expressly permits it.
5. Demos, trials and subscriptions
Demonstrations and trials may have limited functionality, usage or duration. Subscription scope, fees, billing dates, renewal, usage allowances and cancellation rights are set out in the applicable order or plan. Unless an order states otherwise, taxes are additional where legally due.
6. Customer data and instructions
You retain responsibility for data you submit to a service, including ensuring that you have appropriate rights, notices, permissions and lawful bases. Where HexaTech processes personal data for you as a processor, the applicable data processing terms and your documented instructions govern that processing.
7. AI-assisted features and human review
AI-assisted output can be incomplete or inaccurate and should be reviewed before it is relied on or published. You are responsible for configuration, approved knowledge, escalation rules and appropriate human oversight. Do not use the service as a substitute for professional medical, legal, financial or safety advice.
8. Intellectual property
HexaTech and its licensors retain rights in the website, software, designs, documentation, trademarks and service technology. Subject to payment and these terms, you receive a limited, non-exclusive, non-transferable right to use the subscribed service during the agreed term. You retain rights in your own content and data.
9. Third-party services
A service may connect with third-party platforms. Their availability, terms, security and changes are controlled by those providers. You authorise the exchanges needed for a connection you choose, and you are responsible for maintaining the relevant third-party account.
10. Availability and changes
We aim to provide reliable services but cannot promise uninterrupted or error-free operation. We may maintain, secure, improve or modify the service. We will use reasonable efforts to communicate material changes that significantly affect an active subscription.
11. Confidentiality
Each party must protect non-public business, technical and commercial information received from the other and use it only for the relationship, except where disclosure is authorised or legally required.
12. Warranties and liability
Services are provided with reasonable care and skill. Other warranties are excluded only to the extent the law permits. Liability may be further defined in an applicable order or written agreement. Nothing in these terms excludes liability that cannot lawfully be excluded, including liability for fraud or fraudulent misrepresentation, or death or personal injury caused by negligence.
13. Suspension and termination
We may suspend access where reasonably necessary to protect security, prevent unlawful use or address a material breach. Either party may terminate in accordance with the applicable order. On termination, access ends and outstanding amounts remain payable. Provisions intended to continue after termination will survive.
14. Governing law and contact
These terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction, unless mandatory law requires otherwise. Questions can be sent to info@hexa-tech.uk or 25 Cabot Square, Canary Wharf, London, E14 4QZ, United Kingdom.
